What Benefits am I Entitled to—Part 4 Medical Benefits
When injured at work, an injured worker is entitled to have all of their medical expenses covered by their employer or the employer’s insurance carrier. This includes all medical expenses. The injured worker is not liable for co-pays or any out of pocket expenses. The employer or their insurance carrier must pay for all reasonable and necessary medical treatment related to the injury.
Like anything else there are rules that must be followed. The medical provider has to formally submit the bills on proper forms with proper documentation. There are also rules allowing the employer or their insurance carrier to challenge individual bills or courses of treatment. The employer can also go to court to ask that certain conditions no longer need treatment or that further treatment will not improve the injured worker’s condition or alleviate their pain.
It is important that any worker who suffers an injury keep a detailed diary of all doctor visits, prescriptions, treatments, x-rays, MRIs, etc. If an injured worker spends any of their own money for any medical care, they should note it and make sure to get a detailed receipt for later reimbursement.
Recovering from a work injury is hard enough without having to worry about paying for it. Speak to an Abes Baumann attorney today to ensure your rights are protected.
